Welcome to Get Flocked (getflocked.com.au). This website and the related Get Flocked mobile application are owned and operated by EMNZ Holdings Pty Ltd (ABN: 74 681 863 865). Throughout the site, the terms “we”, “us” and “our” refer to Get Flocked. By accessing our site, downloading our mobile application, and/or purchasing products from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms, conditions, and policies referenced herein or available by hyperlink.
Please read these Terms of Service carefully before accessing or using our website or mobile application. If you do not agree to all the terms and conditions of this agreement, then you may not access the website, download the app, or use any services.
1. Live Order Amendments & Cancellations
Due to our automated, rapid fulfillment workflows, we cannot guarantee any amendments, item additions, or cancellations can be executed after an order has been submitted through our online storefront or mobile application.
Urgent Requests: Any emergency modification requests must be immediately directed to our customer service team via phone at 1300 946 741. Email notifications, contact form messages, or order notification replies are not monitored in real-time and do not guarantee package intercept.
Cancellation Fees: If a manual order cancellation is approved at our absolute discretion prior to fulfillment, a 10% administration and restocking fee will be deducted from the reverse transaction to cover non-refundable merchant gateway fees, processing costs, and warehouse administration labour.
2. Shipping Logistics, Order Consolidation & Interstate Biosecurity
Shipping charges are calculated live based on carrier cubic weight metrics and regional Australian destination postcodes. Our logistics framework is governed in full by our standalone Shipping & Delivery Policy, supplemented by the following conditions:
- Express Wallets Address Overrides: Users checking out via accelerated payment platforms (including but not limited to Shop Pay, Apple Pay, Google Pay, and PayPal) explicitly acknowledge that these external digital wallets hard-override storefront data fields with historical default customer addresses. It is the consumer's sole responsibility to audit their wallet pop-up address prior to biometric or single-click authorisation. To the maximum extent permitted by law, Get Flocked accepts zero liability for parcels routed to outdated addresses pushed by express wallets.
- Western Australia & Tasmania Quarantine Restrictions: Due to strict state border legislation, biological items marked with (Excl. TAS & WA) cannot legally enter WA or TAS. If a submitted order consists entirely of prohibited biosecurity materials, the order will be cancelled and refunded in full to the original payment method. Where an order contains a mixture of restricted and non-restricted goods, the prohibited items will be cancelled and refunded in full, while the non-restricted goods proceed to fulfillment. In all instances of partial biosecurity cancellation, live freight charges captured at checkout cannot be modified, adjusted, or partially refunded. While we endeavour to process these biosecurity exclusions seamlessly, customers acknowledge that automated filtering rules may occasionally fail due to system variables.
- Right to Consolidate Independent Orders: If a customer processes multiple independent orders within a matching shipping window, Get Flocked reserves the absolute right to combine these orders into a single, unified physical shipping consignment. Customers acknowledge that no partial or full shipping adjustments will be refunded as a result of order consolidation, though Get Flocked will endeavour to upgrade the delivery service to an accelerated carrier tier where practical.
- Return to Sender (RTS): Any consignment returned to our facility due to insufficient address data, non-collection, local delivery rejection, or failure to collect from a Local Post Office (LPO) will incur a flat $13.00 AUD carrier penalty fee, which will be automatically deducted from the resulting store credit balance. Original outward shipping fees remain non-refundable.
- Back-Order Consolidations: Orders containing any items marked as "Back Order" or "Pre-Order" will be held in their entirety until all components arrive from our suppliers to facilitate a single, unified shipping consignment.
3. Biosecurity, Returns & Financial Processing
All change-of-mind return requests must strictly align with our health and safety protocols. This section outlines the master financial terms of our return infrastructure, which is governed in full by our standalone Refund Policy:
- Avian Pathogen Zero-Tolerance: To mitigate the spread of fatal avian diseases (such as Psittacine Beak and Feather Disease - PBFD), returns must be 100% unopened and pristine. All returns undergo forensic inspection under high-intensity UV laboratory light. Any item revealing microscopic biological trace elements (dander, preen oils, or dust) will be rejected.
- Handling of Rejected Returns: If a returned item fails our forensic biosecurity inspection, the customer will be notified and given a strict seven (7) day window to pay a standard shipping freight fee to have the item returned to them, or authorise our warehouse to safely dispose of it. Unactioned items after 7 days will be automatically destroyed for biosafety reasons.
- Store Credit & Restocking Fees: Approved change-of-mind returns are settled solely via non-transferable Store Credits, subject to a mandatory 11% restocking fee. Original outward shipping fees and promotional discount values are non-refundable. Digital Gift Cards are final sale items and cannot be returned or refunded.
4. Purchase Options & Automated Subscriptions
By activating a purchase option sequence (including Auto Delivery subscriptions, pre-orders, or try-before-you-buy items), you explicitly authorise Get Flocked to securely store your payment token and charge your designated payment profile on a recurring or future schedule. Detailed walkthroughs are visible under our custom FAQ - Help Centre, backed by the following mandates:
- Subscription Modifications: There are no long-term contractual volume commitments; your baseline commitment is simply the initial order placed. Customers maintain autonomous control over skipping, shifting, pausing, or cancelling schedules via their digital dashboard at any time up until the exact second the automated renewal payment is processed. Once a renewal transaction is successfully executed and captured by our payment processor, the order instantly enters our rapid fulfillment workflow and cannot be modified, cancelled, or reversed.
- Profile Sync Limitations: Profile address updates made to your primary storefront account do not alter active subscription data; consumers must separately update shipping coordinates within the subscription manager panel to ensure correct routing.
- Pre-Orders & Authorisations: Pre-ordered items will be processed and captured at a future date upon stock availability. Try-before-you-buy items involve a standard payment method pre-authorisation, with full capture executed automatically if the item is not returned within the designated trial timeframe.
5. Promotions, Code Stacking & Loyalty Restrictions
While specific configured promotions may stack natively at checkout via Shopify’s engine parameters, any order completing checkout utilising a promotional coupon code, automated sitewide discount, or existing Store Credit balance is completely barred from accumulating fresh Flock Rewards loyalty credits. Loyalty reward accumulation strictly applies to un-discounted retail product subtotals, excluding GST, freight surcharges, and shipping options. 6. Flock Rewards Program
By participating in the Flock Rewards loyalty program, you agree to the following terms, which supplement any specific technical layout rules published inside our FAQ - Help Centre:
- Program Integrity: Flock Rewards accounts, points, and tier statuses are non-transferable, have no cash value, and cannot be redeemed or exchanged for physical currency.
- Expirations & Adjustments: We reserve the right to audit, adjust, or revoke accumulated rewards balances at any time if we detect system errors, technical glitches, fraudulent activity, or a breach of these Terms.
- Modifications and Termination: To the maximum extent permitted by law, Get Flocked reserves the right to modify, suspend, or terminate the Flock Rewards structure, point valuation, redemption mechanics, or tier benefits at our absolute discretion, with or without prior notice.
7. Get Flocked Mobile Application
By downloading, installing, or utilising the Get Flocked mobile application (the "App") via the Apple App Store or Google Play Store, you agree to be bound by these additional terms:
- Limited Licence: EMNZ Holdings Pty Ltd grants you a personal, limited, non-exclusive, non-transferable, and revocable licence to download and use the App on a compatible mobile device solely for your personal, non-commercial shopping use. You must not reverse-engineer, modify, hack, or distribute any part of the App.
- Push Notifications & Communication: By installing the App and enabling permissions, you explicitly consent to receive automated push notifications from Get Flocked. These may include operational updates (such as tracking, subscription reminders, and fulfillment alerts) as well as marketing and promotional campaigns. You maintain autonomous control over these communications and can opt out or adjust your notification preferences at any time via your mobile device’s native operating system settings.
- App Store Application Terms: You acknowledge that these Terms of Service are concluded strictly between you and Get Flocked (EMNZ Holdings Pty Ltd), and not with Apple Inc. or Google LLC. Apple and Google have no obligation whatsoever to furnish any maintenance or support services with respect to the App. Your use of the App is conditional upon your ongoing compliance with the respective Apple Media Services Terms and Conditions or Google Play Terms of Service.
- Updates, Maintenance & Compatibility: We reserve the right to deploy mandatory patches, security updates, or feature overhauls to the App at any time without prior notice. To the maximum extent permitted by law, Get Flocked does not guarantee that the App will remain compatible with your specific mobile device model, network carrier, or operating system version.
8. Product Suitability, Safety & Disclaimers
Our products are intended for animal use and deployment under strict conditions:
- Product Selection: It is the consumer’s sole responsibility to review product descriptions, dimensions, and the "Recommended For" sections to ensure an item matches their specific bird’s size, species, strength, and behavioural traits. Actual product colours, dimensions, and designs may vary slightly due to studio lighting, device screen variations, or natural raw material finishes.
- Safety & Mandatory Supervision: No animal toy or accessory is completely indestructible. Consumers must inspect all products daily for signs of structural wear, fraying, loose threads, splitting wood, or broken parts. Damaged items must be removed from the animal’s environment immediately to prevent injury, entanglement, or ingestion. All products must be used under strict human supervision and kept completely out of reach of human children.
- No Medical Advice: Information, educational content, sizing guides, or customer service communications provided on getflocked.com.au or within our mobile application are for general guidance only and do not substitute for professional avian veterinary consultation. For specific animal healthcare concerns, diagnostics, or medical emergencies, you must consult a qualified veterinarian immediately.
9. Accuracy of Information & Pricing Errors
We reserve the right to refuse service, terminate customer accounts, or cancel orders at our absolute discretion. In the event that a product is mistakenly listed at an incorrect price, with inaccurate stock availability metrics, or with typographical errors due to system glitches, Get Flocked reserves the right to cancel or refuse any orders placed for that item, regardless of whether the order has been confirmed and your payment processed. If your payment has already been captured for a cancelled order, a full refund will be issued via the original payment method.
10. Intellectual Property
All content displayed on getflocked.com.au and within our mobile application—including but not limited to text, graphics, logos, brand names, product descriptions, bespoke photography, visual layouts, and code assets—is the exclusive intellectual property of EMNZ Holdings Pty Ltd. Unauthorised reproduction, modification, distribution, scraping, or commercial exploitation of this material is strictly prohibited without our express prior written consent. Third-party vendor trademarks displayed across our digital catalogue remain the property of their respective trademark holders and are utilised purely to identify retail goods.
11. Australian Consumer Law (ACL) & Limitation of Liability
These Terms of Service are governed by and construed in accordance with the laws of Queensland, Australia. Any formal legal disputes arising from this contract will be handled exclusively within the jurisdiction of Queensland courts. Nothing within these terms aims to override, limit, or exclude statutory consumer guarantees legally afforded to consumers under the Competition and Consumer Act 2010 (Cth).
To the maximum extent permitted under the Australian Consumer Law, Get Flocked, its directors, officers, and its suppliers accept no liability for any damage, loss, illness, personal injury, or death caused directly or indirectly to any animal or person arising from the selection, use, misuse, lack of structural inspection, or unsupervised deployment of our products. Proper selection, continuous behavioural risk assessment, and supervised deployment remain the absolute responsibility of the animal’s owner.
12. Severability & Updates to Terms
Severability: If any provision, clause, or sub-clause of these Terms of Service is determined by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that specific provision will be severed or modified to the minimum extent necessary, and the remaining provisions of these Terms will continue in full force and effect.
Amendments: We reserve the right to update, change, or replace any part of these Terms of Service by posting updates to our website or app interface. It is your responsibility to check our platforms periodically for changes. Your continued use of or access to the website or App following the posting of any changes constitutes explicit acceptance of those updates.
